Terms of Service – Park Passport Journey

1. Introduction
Welcome to Park Passport Journey (the “App”). These Terms of Service (“Terms”) are a legal agreement between you and AJE Technology Solutions, LLC (“we,” “us,” or “our”) that govern your use of the App and any related services.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Important: We are not affiliated with, endorsed by, or sponsored by the National Park Service, the U.S. Department of the Interior, or any government agency. All park names and designations are used for informational purposes only.
2. Eligibility and Account
- You must be at least 13 years old (or the minimum age in your jurisdiction) to use the App.
- The App uses your Apple ID and, if enabled, iCloud to store and sync your data across devices.
- We do not create or manage separate user accounts on our own servers.
Parents or guardians are responsible for use of the App by children.
3. Data Storage and iCloud
Park Passport Journey is designed to be privacy-first:
- Your park visits, stamps, photos, notes, journals, and other content (“User Content”) are stored on your device and, if you enable it, in your personal iCloud account.
- We do not operate our own backend server for your User Content and do not have access to your iCloud data.
Because we do not store your User Content on our servers:
- We cannot restore lost data for you.
- You are responsible for managing your iCloud settings, device backups, and storage.

4. Subscriptions, Purchases, and Billing
Some features of the App may be offered as paid features, such as one-time purchases or recurring subscriptions (“Subscriptions”).
- Purchases and Subscriptions are handled through Apple’s App Store using your Apple ID.
- Pricing, billing frequency, free trials, and renewal terms are displayed in the App Store at the time of purchase.
- Unless otherwise stated, Subscriptions auto-renew until you cancel. You can manage or cancel your Subscription at any time through your Apple ID account settings.
Refunds:
Refunds, if any, are handled directly by Apple under their policies. We do not process or guarantee refunds ourselves.
We reserve the right to change our pricing and the features included in free or paid tiers, but changes will not retroactively affect previous purchases already fulfilled.
5. License and Intellectual Property
5.1 License to You
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to:
- Download and use the App on devices you own or control, and
- Use the App solely for your own personal, non-commercial purposes.
You may not:
- Reverse engineer, decompile, or attempt to derive the source code of the App (except where allowed by law).
- Copy, modify, or create derivative works of the App.
- Remove or alter any copyright, trademark, or other proprietary notices in the App.
5.2 Our Intellectual Property
All content and materials in the App (excluding your User Content), including but not limited to the app name, logos, designs, graphics, UI, and code, are owned by or licensed to AJE Technology Solutions, LLC and are protected by intellectual property laws.
You may not use our name, logo, or branding without our prior written permission.
5.3 User Content and Ownership
You retain all rights to your User Content (e.g., notes, photos, journals, visit records, stamp images).
By using the App, you grant us a limited, non-exclusive license to process your User Content on your device and through iCloud solely as needed to operate and improve the App (for example, rendering your stamps, loading your visits, generating badges, etc.). This license is:
- Only for App functionality.
- Not used by us for advertising or selling your data.
- Subject to the privacy practices described in our Privacy Policy.
6. Prohibited Use
You agree not to:
- Use the App for any illegal purpose or in violation of any law or regulation.
- Attempt to gain unauthorized access to any systems or networks related to the App.
- Use the App in a way that could damage, disable, overburden, or impair its operation.
- Circumvent or attempt to circumvent any security or access controls in the App.
- Use the App to harass, abuse, or harm others.
We may, at our discretion, suspend or terminate your access to the App if we believe you are violating these Terms.
7. Trail Information, Safety, and Third-Party Content
The App may show information such as park locations, trails, hikes, difficulty ratings, distances, and other travel-related content.
- This information may come from public sources or may be curated by us, but it may not always be current, complete, or accurate.
- Conditions in parks and on trails can change rapidly due to weather, closures, wildlife, or other hazards.
You agree that:
- You are solely responsible for your own safety and decisions when visiting parks and trails.
- You will verify critical details (closures, conditions, safety guidance, regulations) from official park authorities or other reliable sources before acting on information in the App.
The App may also contain links to third-party websites or services. We are not responsible for those third-party sites, their content, or their privacy practices.
8. No Affiliation with National Park Service
Park Passport Journey is an independent application and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with:
- The National Park Service
- The U.S. Department of the Interior
- Any other government agency
All park names, designations, and logos (where referenced) are the property of their respective owners and are used for identification and informational purposes only.
9. Disclaimers
The App is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law:
- We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that the App will be uninterrupted, secure, or free from errors or defects.
- We do not guarantee that any data stored on your device or in iCloud will be preserved without loss or corruption.
You use the App at your own risk.
10. Limitation of Liability
To the fullest extent allowed by law, in no event will AJE Technology Solutions, LLC., its officers, employees, or affiliates be liable for:
- Any indirect, incidental, special, consequential, or punitive damages, or
- Any loss of data, revenue, profits, or goodwill,
arising out of or relating to your use of the App, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of:
- The amount you paid for the App or related in-app purchases during the three (3) months preceding the claim, or
- US $10.
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless AJE Technology Solutions, LLC. and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with:
- Your use of the App,
- Your violation of these Terms, or
- Your violation of any law or the rights of a third party.
12. Changes to the App and to These Terms
We may update or change the App (including adding, modifying, or removing features) and we may update these Terms from time to time.
When we make material changes to these Terms, we will:
- Update the “Last updated” date at the top, and
- Provide notice within the App or through other reasonable means.
By continuing to use the App after the changes become effective, you agree to the revised Terms. If you do not agree, you must stop using the App.
13. Termination
You may stop using the App at any time by deleting it from your device and adjusting your iCloud settings as you choose.
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the App.
Upon termination:
- Your license to use the App ends.
- Any User Content stored in iCloud remains in your iCloud account until you remove it or adjust your iCloud settings, subject to Apple’s terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the App will be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.
